In this case, the oral agreement between MLB and Bygone Sports should justify the Nats being able to use their own name in selling team apparel. Bygone seems to be looking for a little publicity, since the company waited over a year and a half to say that "it wasn't a written agreement". Sure, they filed for the patent in '02 to sell baseball memorabilia under the Washington Nationals name. But, if they seriously had a problem with a new baseball team under the same name, then they would've taken action much sooner.
